How are losses indemnified under the liability insurance of architects and designers?
The liability of architects and designers has been regulated pursuant to the General Conditions of Contracts for Design Services (Projekteerimise töövõtulepingu üldtingimused, PTÜ 2004). The maximum limit of liability is established in a contract for design services. If no maximum limit has been established in the contract, the designer and the architect will be liable to the extent of the proven losses. Liability insurance will not be applicable if the loss has been caused as a result of the wrongful acts of the designer or architect.
